1. Member Agreement

This agreement covers the details of your membership, ensuring transparency and trust. From eligibility and account security to respectful conduct and content guidelines, we’re focused on building a supportive space for your musical creativity. You retain ownership of your creations while granting us the right to showcase your talent within our community. Your privacy matters to us, and our Data Retention Policy ensures your information is handled with care.

By becoming a member of our songwriting community, you agree to the terms and conditions outlined in this Member Agreement.

  1. Eligibility — To become a member of Talent Is Timeless, you must be at least 50 years old. Our community is specially curated for mature songwriters who bring a wealth of experience and passion to their craft.
  2. Participation and Conduct — Respect others; uphold positivity; follow our Terms & Conditions and Privacy Policy.
  3. Creative Content — You retain full ownership of the songs and content you share. By posting, you grant us a non-exclusive license to use, display, and promote your work within the community.
  4. Privacy and Data — We handle your data with care. Please review our Privacy and Data Retention policies.
  5. Membership Fees — Some features and services require membership fees. By subscribing, you gain access to exciting songwriting challenges, online courses, and inspiring retreats around the world.
  6. Termination — Either party may terminate this agreement at any time, with or without cause.
  7. Support and Feedback — Questions or ideas? Contact us — your feedback helps improve the community.
  8. Governing Law — This Member Agreement is governed by the laws of the United Kingdom.

2. Terms & Conditions

Introduction

  1. These Terms and Conditions govern the use of our songwriting membership website, competitions, retreats, and other services provided by Talent Is Timeless LTD (“Talent Is Timeless,” “we,” “us,” or “our”). By accessing or using our website and services, you agree to be bound by these Terms and Conditions.

2.1 Eligibility

Age Requirement — You must be at least 50 years old. To use our services and become a member of Talent Is Timeless, you must be at least 50 years old. Our community is exclusively designed for mature songwriters who bring a wealth of experience and passion to their craft.

2.2 Geographic Limitations

While we welcome members globally, some services may have geographic restrictions.

2.3 Participation & Conduct

  • Respect Others — Treat fellow members with kindness, respect, and empathy.
  • Uphold Positivity — Share constructive feedback and encouragement.
  • Follow the Rules — Abide by these Terms and our Privacy Policy.

2.4 Artificial Intelligence (AI) Policy

Our Philosophy

We use AI to support human connection, not replace it.

Customer Support Enhancement

  • We operate TITA (Talent Is Timeless Agent) at [email protected] for technical/informational support.
  • Members may request a human at any time by saying “talk to a human please.”

Communication Enhancement

  • We may use AI tools to enhance writing/grammar in communications.

Event Documentation

  • Monthly masterclasses may be recorded and summarized with AI.
  • We do not record creative sessions where members create or share original material.

AI in Music Creation

  • Monthly challenges: AI-assisted songs are welcome.
  • Annual contest:
    • “AI in music” includes AI for melody, lyrics, or chord creation.
    • AI-assisted songs must be entered in the designated AI category only.
    • The lyrics-only contest prohibits AI assistance.
    • Full AI usage rules are detailed in our contest terms and conditions.

Contest Judging

  • We do not use AI to judge songs. Judges rely on their human expertise.
  • Judges are encouraged not to use AI writing/grammar tools when providing feedback.

Transparency & Choice

  • We strive to disclose when AI assists content/communication. You can always request human help.

Data & AI

  • Any AI systems we use follow our Privacy Policy. Your personal information and creative content are not used to train external AI systems without your explicit consent.

2.5 Creative Content

  • Ownership & License Grant — You retain ownership of your songs and content. By posting, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and promote your work to operate and promote the platform.
  • User-Generated Content — All member content must comply with our Community Guidelines. We may remove or modify content that violates these Terms or the Guidelines.

2.6 Intellectual Property Rights

  • Ownership — Talent Is Timeless and its licensors retain all rights in the website, services, and content (including logos, trademarks, and copyrighted materials).
  • Copyright Infringement — See Copyright & DMCA Policy for notice procedures.

2.7 Payment & Fees

  • Membership Fees — Some features require paid membership.
  • Payment Terms — Fees are billed monthly or annually in advance in the stated currency using accepted payment methods. Fees will be billed monthly or annually in advance, and you authorize Talent Is Timeless to charge the provided payment method for the applicable fees and any additional charges that may arise.
  • Automatic Renewal — Membership auto-renews unless cancelled before the billing cycle ends. Unless you cancel your membership before the end of the billing cycle, your membership will automatically renew for the same duration, and you authorize us to charge your payment method accordingly. You can opt-out of automatic renewal by adjusting your account settings.
  • Refund Policy — Membership fees are non-refundable except as required by law or stated in our Refund Policy.
  • Fee Changes — We may modify fees; changes will be communicated via the website or email prior to implementation.

2.8 Privacy & Data

Please review our Privacy and Data Retention policies for how we collect, use, and disclose personal information.

2.9 Termination

  • Account Termination — We may suspend or terminate accounts at our discretion, with or without cause and without notice.
  • Effect of Termination — You will lose account access; some posted content may be removed. Sections 4, 5, 6, and 10 survive termination.

2.10 Limitation of Liability

To the fullest extent permitted by law, we are not liable for direct, indirect, incidental, special, or consequential damages arising from use of our website and services.

2.11 Dispute Resolution

Disputes shall first be addressed through friendly discussions or mediation.

2.12 Governing Law

These Terms & Conditions are governed by the laws of the United Kingdom.

2.13 Modifications to Terms

We may modify these Terms at any time. Changes take effect upon posting on our website. It is your responsibility to review these Terms and Conditions regularly.

2.15 Account Security and Password Requirements

You are responsible for maintaining the security of your account and password. To protect your account and our community:

    • Create a strong, unique password: Your password must be at least 8 characters and achieve “Medium” or stronger security as measured by our password strength indicator during registration. We recommend using three or more random words combined together (e.g., “purple-mountain-coffee”), which creates a strong password that’s easy to remember.
    • Avoid weak passwords: Do not use common passwords (like “password123”), keyboard patterns (like “qwerty”), repeated characters, or personal information that could be easily guessed.
    • Keep your password unique: Do not reuse passwords from other websites or services. If another site you use is compromised, reusing passwords could put your Talent Is Timeless account at risk.
    • Keep your password confidential: Never share your password with anyone. Talent Is Timeless staff will never ask for your password.
    • Report suspected compromise immediately: If you believe your account has been compromised, change your password immediately and contact us at [email protected].

3. Community Guidelines

Introduction — We foster a supportive, creative environment for songwriters over 50.

Respectful Conduct

Treat all members with respect and kindness. Avoid offensive language, personal attacks, and harassment. We encourage constructive feedback and discussions.

Prohibited Content

Do not post content that is illegal, harmful, offensive, or violates the rights of others, including content that promotes violence, discrimination, or hate speech.

Intellectual Property

Respect copyright and intellectual property rights. Do not post copyrighted material without proper authorization.

Consequences of Violation

Violations may result in content removal and/or account suspension or termination. Talent Is Timeless reserves the right to remove any content that violates these guidelines.

4. Child Safety Standards Policy

1. Introduction

Talent Is Timeless is committed to providing a safe and inclusive online environment, including for vulnerable individuals. This policy addresses prevention, identification, and response to child sexual abuse and exploitation (CSAE).

2. Scope

Applies to all users, staff, moderators, volunteers, and third parties involved in running online events and workshops; covers website interactions including messaging, group pages, comments, and uploads.

3. Definitions

  • Child Sexual Abuse (CSA): Any sexual activity with a child, including grooming, exploitation, and coercion.
  • Child Sexual Exploitation (CSE): Sexual abuse involving manipulation or coercion in exchange for benefits.
  • Grooming: Building connection with a child to exploit or abuse them.

4. Safeguarding Measures

  • Age Restriction & Verification — Platform intended for people 50+. Reasonable measures help prevent underage access.
  • Moderation & Monitoring — Group pages, comments, and direct messages may be monitored (AI-powered and manual). Users can report via Report Abuse; reviewed by designated moderators.
  • Code of Conduct — Prohibits CSAE (including grooming and sharing/soliciting sexual content involving minors). Violations may result in immediate suspension and legal action.
  • Reporting & Response — Report suspected CSAE to [email protected]. Reports are confidential and promptly investigated; incidents may be reported to law enforcement and relevant agencies.
  • Education & Support — Regular awareness guidance for members; moderators/staff receive CSAE awareness training.

5. Consequences

Immediate suspension or permanent ban; report to law enforcement; collaboration with platforms/organizations as needed.

5.5 Refund and Cancellation Policy

Effective Date: 12 Mar 2026

Statutory Cancellation Rights

Where a booking or membership is purchased online, by telephone, or through another distance or off-premises method, consumers have a statutory right to cancel the contract within 14 days without giving any reason, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

The cancellation period begins on the day the contract is entered into and ends 14 days later. If cancellation occurs within this period, all payments received will be refunded without undue delay and no later than 14 days after the cancellation is confirmed.

If a consumer expressly requests that services begin during the 14-day cancellation period, and subsequently cancels within that period, a proportionate amount may be deducted from the refund to reflect services already supplied, as permitted by law.

Membership Fees

Our membership is an online service that becomes available to you immediately upon purchase. By agreeing to these Terms and Conditions at the point of purchase, you expressly request that your membership begins immediately and acknowledge that, by doing so, you waive your 14-day statutory cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

As a goodwill gesture, we offer a 30-day satisfaction period for new memberships. If you are not satisfied within the first 30 days, you may request a full refund by contacting [email protected], no questions asked. After this period, membership fees are non-refundable except where required by applicable consumer law. Approved refunds are processed within 10 business days.

Retreats and In-Person Events

For retreat and in-person event bookings cancelled after the statutory cancellation period has expired, the following refund schedule applies, reflecting non-recoverable costs committed by that date:

  • More than 3 months before the event start date: 100% refund.
  • Between 6 weeks (42 days) and 3 months before the event start date: 50% refund.
  • Less than 6 weeks (42 days) before the event start date: No refund.

Cancellation requests must be submitted in writing to [email protected]. The applicable refund tier will be determined based on the date the written cancellation request is received. Upon request, written confirmation of booking and the applicable cancellation terms may be provided for travel insurance purposes.

Exceptional Circumstances

Where extraordinary and unforeseen circumstances prevent attendance at a retreat or in-person event, a request for a refund or transfer may be submitted for review. Examples of circumstances that may be considered include:

  • The death of an immediate family member (spouse, partner, parent, child, or sibling);
  • A serious or life-threatening medical emergency affecting the member or an immediate family member; or
  • Force majeure events such as war, civil unrest, or natural disasters that directly prevent travel or attendance.

Requests must be submitted in writing to [email protected] as soon as reasonably practicable and may require supporting documentation. Each request will be assessed on a case-by-case basis in accordance with applicable consumer law. Nothing in this section limits or excludes any statutory rights available to consumers.

5.6 Intellectual Property Policy

5.7 Data Retention Policy

We retain user data as long as necessary to provide services and meet legal obligations. To request data removal, email [email protected].

5.8 Communication & Marketing Policy

  • Service communications related to your account and updates may be sent occasionally.
  • You may opt out of marketing emails via the “Unsubscribe” link.

5.9 Terms of Service for Online Courses

Effective Date: 28 July 2023

  • Enrollment & Access — Access to course materials for the specified duration.
  • Course Content — For educational purposes only; not professional advice.
  • Limitations — We may limit or revoke access in cases of misuse or policy violations.

5.10 Code of Conduct for Retreats & Events

  • Respectful Behavior — Treat all participants and staff with respect and consideration.
  • Inclusivity — Create a welcoming environment for diverse backgrounds and perspectives.
  • Harassment-Free — No verbal, physical, or visual harassment.
  • Substance Use — Follow venue rules.
  • Compliance with Laws — Follow local laws throughout the event.
  • Confidentiality — Respect others’ privacy; do not share personal info without permission.
  • Policy Compliance — Adhere to all Talent Is Timeless policies.
  • Reporting — Report concerns to organizers/staff promptly.
  • Consequences — Violations may result in immediate expulsion without refund and potential bans from future events.

5.11 Violent Content Policy

Purpose

Talent Is Timeless is committed to a safe, creative, and respectful environment. Content that promotes, glorifies, or incites violence is not permitted.

Definition

  • Songs, lyrics, videos, or other creative works that encourage physical harm against individuals or groups.
  • Content that glorifies violent acts or presents them in a way intended to incite imitation.
  • Material that could reasonably be interpreted as a call to violence or an endorsement of harming others.

Enforcement

  • Content suspected of violating this policy may be temporarily hidden while under review.
  • Confirmed violations will be removed.
  • Depending on severity or frequency, consequences may include warning, suspension, or permanent termination (per the Terms & Conditions).
  • Credible threats or incitement to unlawful activity may be referred to law enforcement or relevant authorities.

Notification and Appeals

  • Members will be notified if content is removed under this policy.
  • Appeals: contact [email protected]. Appeals will be reviewed fairly and promptly.

5.12 Free Pre-Registration Memberships (Competition)

By pre-registering for an Annual Songwriting Competition, a complimentary membership will be created to facilitate participation.

  • Data Usage — Data provided during pre-registration is used to manage competition progress; not shared with third parties.
  • Limited Membership — Access primarily for competition-related communications, the Competition Group Forum, community map, and member connections.
  • Right to Cancel — We may cancel or modify free memberships at any time, with or without cause and without notice.
  • Privacy — See our Data Retention Policy; contact [email protected] for concerns.
  • Applicability — Pre-registrants are also subject to the Member Agreement and Terms & Conditions.

5.13 Early Bird Contest Entry Credits

5.13.1 Early Bird Credit Purchase Period

Early Bird Contest Entry Credits (“Early Bird Credits”) are available for purchase exclusively during the month of December preceding each annual contest year. The Early Bird offer concludes at 23:59 GMT on December 31st. From January 1st onwards, standard contest entry pricing applies, and Early Bird Credits are no longer available for purchase.

5.13.2 Credit Validity and Expiration

Early Bird Credits purchased by members do not expire. Credits may be redeemed for contest entries in the year of purchase or in any subsequent year in which the Talent Is Timeless Annual Song Contest is held. Talent Is Timeless makes no guarantee that the contest will continue indefinitely, but all purchased credits remain valid for use in any future iteration of the contest.

5.13.3 Credit Redemption and Usage

Each Early Bird Credit entitles the holder to submit one (1) song entry to the Talent Is Timeless Annual Song Contest. Credits may be redeemed for entries in any genre or country category for which the member qualifies. Credits may be used across multiple contest years and are not restricted to a single competition cycle.

5.13.4 Standard Contest Entry Pricing

From January 1st of each contest year, standard entry pricing applies as follows:

  • Non-members: £30 per entry
  • Premium Members: £20 per entry

Early Bird Credits allow members to secure entries at preferential rates that may be substantially lower than standard pricing.

5.13.5 Credit Transfer and Gifting

Members may transfer or gift Early Bird Credits to other Talent Is Timeless members, including members with free accounts. The transferring member (“Transferor”) must initiate the transfer through their account dashboard or by contacting Talent Is Timeless support. Once transferred, credits become the property of the receiving member (“Transferee”) and may be used at the Transferee’s sole discretion. Credit transfers are final and may not be reversed except at the sole discretion of Talent Is Timeless.

5.13.6 Credit Display and Management

Members may view their current Early Bird Credit balance through their account dashboard. Talent Is Timeless shall maintain accurate records of all credit purchases, redemptions, and transfers. Members are responsible for monitoring their own credit balance prior to submitting contest entries.

5.13.7 Non-Refundability of Credits

Early Bird Credits are non-refundable under all circumstances, except where required by applicable law. Credits may not be exchanged for cash, membership fees, or any other services provided by Talent Is Timeless.

5.13.8 Account Requirements for Credit Usage

No paid membership is required to purchase or redeem Early Bird Credits. A free Talent Is Timeless account is sufficient to hold credits and submit contest entries. Non-members may purchase credits without being logged in, in which case the credit purchase will include the creation of a free membership account to which the purchased credits will be assigned. Members may subsequently log in to access their credits and manage their contest submissions. Premium Members receive discounted standard entry pricing but may also purchase and use Early Bird Credits at the same rates as non-Premium members.

5.13.9 Payment Processing and Credit Allocation

Early Bird Credits are added to a member’s account immediately upon successful payment processing. Payment is processed securely through Stripe. Members will receive email confirmation of their purchase and may view their updated credit balance in their account dashboard. Credits become available for redemption when the contest opens on January 1st of each contest year.

5.13.10 Multiple Entries and Strategic Submissions

Members may use multiple Early Bird Credits to submit multiple songs to a single contest cycle. Each entry receives independent consideration by the judges. Members may submit songs across different genres and categories, submit both new compositions and previously entered work, and enter as many songs as their credit balance permits. All entries are subject to the contest rules and eligibility requirements set forth in Section 6 of these Terms and Conditions.

5.13.11 Feedback Guarantee

Regardless of whether an entry is submitted using an Early Bird Credit or standard payment, every contest entry receives written feedback from two (2) independent judges. This feedback is provided as part of the contest experience and is not contingent upon the method of payment.

5.13.12 Changes to Early Bird Programme

Talent Is Timeless reserves the right to modify, suspend, or discontinue the Early Bird Credits programme at any time, with or without notice. Any such changes shall not affect credits already purchased, which remain valid for redemption according to the terms in effect at the time of purchase. Talent Is Timeless may adjust Early Bird pricing, bundle offerings, or promotional structures for future purchase periods without obligation to honour previous pricing for new purchases.

6. Contest & Competition Rules (General)

  • Eligibility — Open to members who meet criteria for each event; some contests may have geographic restrictions.
  • Submission Guidelines — Follow contest-specific submission instructions; non-compliant entries may be disqualified.
  • Judging Criteria — Communicated separately; judges’ decisions are final.
  • Prizes — Specified per event.
  • Rights & Usage — By entering, you grant Talent Is Timeless the right to use your submission for promotional purposes within the community.
